I think the FSF needs to be careful here. The current license seems to indeed be ineffective. The third-party obligation problem is valid. GPLv3 can not control Microsoft"s actions (providing coupons is not distribution). Instead, GPLv3 should control Novell, by blocking Novell (or anyone else) from distribution while an exclusive patent license theya arranged is in effect.
